Ces deux décisions en date du 16 septembre 2025 ont pour fondement l’article 138 de la constitution ivoirienne qui indique que les décisions du Conseil Constitutionnel ne sont susceptibles d’aucun recours et s’imposent à toutes les institutions, à tous les citoyens et à tous agents de l’administration publique.
Ainsi, toute remise en cause, constitue une violation de la loi.
Le 08 septembre dernier, le Conseil Constitutionnel ivoirien a dévoilé la liste définitive des candidats retenus pour l’élection du président de la République du 25 octobre 2025.
Cinq candidats sur 60 ont été retenus par le Conseil Constitutionnel pour cette échéance électorale.
Il s’agit des candidats Alassane Ouattara, Ehivet Simone Épouse Gbagbo, Jean Louis Billon, Ahoua Don Mello et Henriette Lagou.
Toutefois, le juge constitutionnel a recalé, pour divers motifs, les candidatures de principaux opposants comme Laurent Gbagbo ( PPA-CI), Cheick Tidjane Thiam ( PDCI-RDA) et Pascal Affi N’Guessan ( FPI).
Les partis politiques dont sont issus ces candidats recalés, s’insurgent contre cette décision du Conseil Constitutionnel dénonçant un » déni de droit « .
Le PPA-CI de Laurent Gbagbo, par exemple, a lancé lundi dernier, une campagne nationale de dépôt de motions dans les préfectures du pays pour dénoncer le rejet de la candidature de son mentor.
