L’ancien ministre ivoirien des Droits de l’Homme, Joël N’Guessan, fait désormais l’objet de poursuites judiciaires. Dans un communiqué rendu public le 19 juin 2025, le Procureur de la République près le Tribunal de première instance d’Abidjan a annoncé l’ouverture d’une information judiciaire à l’encontre de l’ex-membre du gouvernement, assortie d’un mandat de dépôt.
À l’origine de cette procédure, une interview accordée par Joël N’Guessan à un média en ligne, diffusée le 18 juin 2025, dans laquelle il accuse ouvertement certains magistrats d’être responsables des crises traversées par la Côte d’Ivoire. Il y déclare notamment : « Ce sont certains Magistrats qui sont à la base de tous les problèmes que nous avons connus », avant d’ajouter que « si demain, il y a des troubles dans le pays, les premiers responsables, ce sont les Magistrats. Ce ne sont pas les hommes politiques ».
Ces propos, jugés diffamatoires, ont été repris par plusieurs médias et sont considérés par le parquet comme attentatoires à l’honneur et à la crédibilité de l’institution judiciaire. Selon le communiqué, les déclarations de Joël N’Guessan sont constitutives d’infractions prévues et punies par les articles 179-1, 190, 273 et 275 du Code pénal.
Le Procureur de la République a tenu à rappeler que les magistrats, dans l’exercice de leurs fonctions, ne font qu’appliquer la loi, en toute impartialité. Il met également en garde contre toute tentative de jeter le discrédit sur la justice, en soulignant que de tels actes ne resteront pas impunis.
Par cette démarche, le parquet d’Abidjan entend réaffirmer l’autorité de la justice et la nécessité de respecter les institutions de la République.
