Bien que radiés des listes électorales, l’ancien président Laurent Gbagbo et le président du PDCI-RDA, Tidjane Thiam, demeurent éligibles, selon Me Faustin Kouamé, ancien ministre de la Justice et Garde des Sceaux.
Lors d’une conférence de presse organisée le mercredi 3 septembre 2025 à Abidjan, Me Faustin Kouamé a tenu à clarifier un débat qui suscite passions et inquiétudes dans la classe politique et au sein de l’opinion nationale. « Les présidents Laurent Gbagbo et Tidjane Thiam demeurent éligibles nonobstant leur radiation de la liste électorale », a-t-il affirmé, expliquant en détail les fondements juridiques de cette position.
Un débat au cœur de la vie politique ivoirienne
La radiation de Laurent Gbagbo et de Tidjane Thiam avait été confirmée par la Commission électorale indépendante (CEI) sur la base de décisions judiciaires contestées, par les concernés. Pour leurs partisans, il s’agit d’une manœuvre visant à « écarter deux figures majeures de l’opposition », capables de peser lourd dans les urnes.
Le pouvoir de son côté rejette toute implication et brandit la carte de « l’indépendance des institutions », notamment la Justice. Pour de nombreux observateurs, cette absence de Laurent Gbagbo et Tidjane Thiam de la liste électorale, remet en question l’éligibilité de ces derniers, évoquant les dispositions de l’article 48 du code électoral ivoirien qui précise que « tout électeur peut-être président de la République »
Le rappel des textes du Code électoral
Pour Me Kouamé, la confusion entre électorat et éligibilité est à l’origine du débat. Dans son argumentaire, il a rappelé que le vote, en Côte d’Ivoire, n’est pas un devoir civique obligatoire, mais un droit facultatif. « Être électeur et être éligible sont deux notions distinctes », a-t-il insisté, en citant les articles 3, 5, 17 et 18 du Code électoral.
Selon lui, l’inscription sur la liste électorale permet de constater la qualité d’électeur, mais son absence ne remet pas nécessairement en cause l’éligibilité. « Être candidat à une élection obéit à d’autres conditions prévues par les textes », a-t-il ajouté. Ainsi, malgré leur radiation, estime le juriste, Laurent Gbagbo et Tidjane Thiam, remplissant les critères liés à la nationalité, à l’âge et à la jouissance de leurs droits civils, « conservent leur droit à briguer la magistrature suprême ».

Évoquant le cas spécifique de Tidjane Thiam, Me Faustin Kouamé explique que « sa situation juridique actuelle a transformé les obstacles électoraux le concernant, lesquels ont été aplanis avant la date butoir du dépôt des candidatures à l’élection présidentielle d’octobre 2025 ».

Le dernier mot revient au Conseil constitutionnel
Alors que la polémique enfle autour de l’éligibilité ou non de Laurent Gbagbo et Tidjane, il est important de souligner que c’est au Conseil constitutionnel qu’il revient la responsabilité de trancher sur le sujet.
Les deux personnalités, faut-il le rappeler, ont déposé leurs dossiers respectifs de candidature à la présidentielle d’octobre prochain et figurent dans la liste des candidats provisoirement retenus pour le scrutin. La liste définitive sera rendue public le 10 septembre prochain.
